Statement of Case:
This is a civil case involving claims of wrongful discharge and disability discrimination by plaintiff Brandiwine Evinger against her former employers, defendants All Clean of Iowa, Emmett Schnathorst and Janice Schnathorst. Ms. Evinger, the plaintiff, claims that the defendants illegally terminated her employment because she complained internally and to the department of labor about payroll practices she reasonably believed were illegal. She also claims that her disability was a factor in the defendants’ decision to terminate her.

The plaintiff requests damages for the defendants’ actions. The defendants deny the plaintiff’s claims and contend they lawfully terminated the plaintiff’s employment.


Statement of Case Defendant:
In this case Plaintiff Brandiwine Evinger claims her termination from employment from All Clean of Iowa, Inc. was wrongful because it was (1) in violation of public policy as a result of her raising issues regarding employee compensation, refusing to participate in illegal activities regarding employee compensation and/or making a claim under the Iowa Wage Payment and (2) in violation of the Iowa Civil Rights Act because she was terminated
because of disability.

Defendants have denied such claims and states that the reasons for terminating Ms. Evinger were legitimate business reasons. Defendants have asserted affirmative defenses of (1) failure to mitigate damages, (2) Plaintiff has no damages, (3) Unclean Hands/In Pari Delicto, (4) Plaintiff failed to pursue available remedies with the Employer, and (5) Plaintiff is not a person with a disability under the Iowa Civil Rights Act.
