I'm almost certain Iowa docs has a form for this.


Yes. Hot Docs has an Affidavit for Distribution of Personal Property.   (Form# P303 attached for your review)


Yes, Iowa allows for use of an affidavit for probate assets of $25,000 total value or less.  It’s in chapter 633.


Maybe an affidavit under Iowa Code 633.356?


I represent a decedent, most of whose assets were in Trust.  The only item outside of the Trust was a small insurance policy of about $3,000 payable to the Estate.

 

We filed a notice to creditors so we could file the will with the court, but did not foresee needing any court involvement.

 

In Illinois, I can simply use a Small Estate Affidavit with a copy of the pour-over will and death certificate to cash the check into the Trust account. 

 

Is there a similar process for Iowa?  Would someone mind sharing a form?  IowaDocs only shows me the court filings for a small estate.   I’d prefer to keep this out of court to reduce cost.
