I received a request from my colleague in China asking whether downloading child porn content from website is a crime based on Maryland law. My general understanding is it should not be as the content is a public information and anyone can access it and download it as long as it is not used for criminal purpose.

This question is raised by a college student’s parents in China. They are worrying about whether their son could have any criminal related record because of downloading the porn content from the website. The student is taking the degree program in Maryland.
