No, wife needs to sign the deed.  Normally the prenupt will have a provision that she agrees to sign all such documents and provides for penalties if she needs to sign and won't.

Dear ISBA Members,

 

Husband and wife have a premarital agreement.  Husband is selling real estate owned only in his name that was purchased before the marriage.  Will recording the premarital agreement eliminate the need for the wife to sign the deed selling this property?  I searched the title standards and Westlaw and have found no legal authority on this issue.
