Dear Listmates,  HAVE A MESS.  WOULD LIKE OPINIONS.

1.      Polk county sheriff deed 8/25/94 to Bank 1 for property A.

2.      1/1/95 ABC Corp. sold property A  to Susan and Sam Smith with a  real estate contract .  ABC Corp. did not own property A.

3.      5/4/98 Bank 1 executed a Warranty deed to ABC Corp. for property A.

4.      2/19/98 ABC Corp.  executed a Warranty deed to DEF Mortgage Co.subject to the Smith’s contract.

5.      10/28/98 XYZ Mortgage co. executes a warranty deed to property A to MNO Mortgage Co.

6.      8/27/99 MNO Mortgage Co. issues an assignment of the mortgage to HIJ Mortgage.

7.      1/9/12 HIJ Mortgage issues a release of property A to Susan and Sam Smith.

A quiet title action has been done giving title to only Susan Smith.

 

In the meanwhile Sam Smith has state tax liens in 2010 and 2011.

So the issues is whether the state tax liens of Sam Smith attach to the house.  I believe that the Smiths never had title until the quiet title action cleared it up and at that point only Susan Smith had title.
