Statement of Case: On or about July 21st, 2019, a Chevy Suburban driven by Defendant Sue Ellen Merical struck a child, Plaintiff E.P., as she was crossing the road at 150 SE Westgate Dr, Waukee, Dallas County, Iowa. Plaintiff E.P. was injured and claims that the injuries are due to Defendant’s negligence. Defendant denies that she was negligent when she struck Plaintiff E.P. The parties dispute the amount of damages. Statement of Case Defendant: In this case plaintiffs claim Defendant was negligent and Defendant's negligence caused damages to the plaintiffs. The defendant denies she was negligent and the damages claimed by the Plaintiffs.
