Statement of Case:
On February 6, 2017, a large art piece fell on Plaintiff Daniel McGarry. The art piece was created and controlled by an employee of Defendant, the State of Iowa. The parties were at the Visual Arts Building located in Iowa City, Iowa. Mr. McGarry claims that the State of Iowa is liable for its employee’s negligent actions in securing and transporting the art piece he had created. Mr. McGarry claims that his injury was the direct and proximate result of the State of Iowa’s negligence.
The State of Iowa denies any liability or fault because its employee was not acting within the scope of his employment at the time of the incident.

Statement of Case Defendant:
The Plaintiff, Daniel McGarry, was injured while assisting Andrew Haley move a large ceramic vase. Mr. McGarry claims that the State of Iowa, through the University of Iowa, was at fault for failing to train Andrew Haley, for negligently
supervising him, and failure to The University of Iowa denies that it was negligent and asserts that because Andrew Haley was not acting within the scope of his employment at the time of the accident, instead he was merely a graduate student at the time of the incident and therefore is not responsible for Mr. McGarry’s injuries.
