Statement of Case:
This is a medical negligence case. The plaintiff (the person filing the lawsuit, is Michelle
Gemant. The defendants, the persons or entities defending the lawsuit, are the Davenport
Surgical Group, P.C., and Genesis Health System doing business as Genesis Medical Center Davenport
and Genesis Health System doing business as Genesis VNA.

As to Davenport Surgical Group, plaintiff alleges that Douglas Khoury, M.D., a physician at Davenport Surgical Group, was negligent in certain respects during the performance of a surgical procedure on April 3, 2019 and was negligent in certain respects in his post operative care of plain ti ff. Also, plaintiff alleges that Kenneth Hartman, M.D., a physician at Davenport Surgical Group, was negligent in certain respects in discharging plaintiff from the hospital on April 10, 2018.

As to Genesis Health system doing business as Genesis Medical Center Davenport, plaintiff alleges that certain nurses and support staff were negligent in their nursing case and treatment of plaintiff post operatively until plaintiffs discharge from the hospital April 10, 2018. Plaintiff further alleges that Genesis Health System, doing business as Genesis VNA, through acts or omissions of the home care nurse on April 12, 2018 was negligent in her care and treatment of plaintiff while in plaintiff's home on April 12, 2018. Plaintiff further alleges that the defendants' acts or omissions caused injuries and resulting damages to plaintiff. Defendants deny they were negligent in the care and treatment of plaintiff, deny that anything they did or did not do in caring for and treating plaintiff and further allege that plaintiff has not been injured to the extent claimed.


Statement of Case Defendant:
This is a medical malpractice case. Plaintiff has sued Defendants, Davenport Surgical Group, P.C. and Genesis Health System. Plaintiff alleges that Defendants’ physicians and nurses were negligent in the care and treatment of Plaintiff Michelle Gernant and as a result of this alleged negligence, Plaintiff suffered damages. Defendants deny that there was any negligence or that Defendants caused any damage. Injuries alleged: Wound infection and subsequent surgery caused by failure to timely diagnose and treat infection following colorectal cancer surgery and premature discharge of Plaintiff from hospital.
