Statement of Case:
On April 14, 2017, Plaintiffs and defendant entered into a contract for the construction of a single-family home at 3121 Lorton Avenue, Davenport, Iowa. The house was constructed and a certificate of occupancy was issued on November 28, 2017, after passing all necessary inspections with the City of Davenport. This case arises out of an alleged breach of contract for non-payment under the terms of the Residential Construction Agreement. Plaintiffs have also alleged unjust enrichment for labor and materials provided and not paid for.
In this case, Plaintiffs claims the final draw under the April 14, 2017 Residential Construction Agreement was not paid by Defendants. Said draw included the final 20% of the contract price, along with additional sums agreed to and attached to said agreement, as well as numerous change orders for upgrades in materials and additional labor and materials provided on the property. Substantial labor and materials were provided by Plaintiffs and not paid for by Defendant.
Plaintiffs returned to the property to correct two extensive punch lists after Defendants took up occupancy of the home.
