Statement of Case:
This is a civil case brought to resolve disputes between an Iowa banking corporation and the managing members of an Iowa limited liability company involved in a business venture of developing certain real estate located in downtown Davenport, Iowa. Northwest Bank & Trust Company is an Iowa banking corporation which will be referred to throughout these instructions as Northwest Bank.
John M. Carroll and John G. Ruhl were, at all times material hereto, the managing members of an Iowa limited liability company known as Pershing Hill Lofts, LLC. Pershing Hill Lofts, LLC was created to acquire and redevelop a building in downtown Davenport, Iowa (hereinafter referred to as the “Project.”)
Northwest Bank has brought various claims against Pershing Hill Lofts, LLC’s managing members, John M. Carroll and John G. Ruhl. Generally, this case involves financing of the Project, with Northwest Bank and otherparticipating lenders. The Project used various types of tax credits. Pershing Hill Lofts, LLC was responsible for submitting applications for the various tax credits, while Northwest Bank coordinated with other participating lenders to provide the loans necessary to finance the Project.
Ultimately, there were issues with getting all the tax credits applied for such that the financing of the Project had to be restructured. The claims by Northwest Bank arise during the parties’ course of dealing in restructuring the financing of the Project.
Northwest Bank alleges that John M. Carroll and/or John M. Ruhl, the managing members, committed fraud by making material misrepresentations, engaging in conduct that misrepresented their intentions and/or failed to disclose material information. Northwest Bank claims damages as a result of these claims. The defendants deny all of Northwest Bank’s claims.

Statement of Case Defendant:
In this case, Plaintiff claims Defendant Dr. Badberg, and Sanford Health Network as her employer, were negligent in their care of Plaintiff during a hospitalization at Sanford Hospital in Sheldon, Iowa, between June 6, 2016, and June 10, 2016.
The Defendants deny they were negligent and deny any acts by Defendants caused damages to Plaintiff. |
